家庭暴力是一个在世界各地普遍存在的社会现象，来自家庭内部、亲密关系人之间的暴力行为一直没有得到有效的遏制。论文以中国裁判文书网为平台，对安徽省近五年涉及家庭暴力婚姻家事案件判决书进行数据分析，梳理司法适用现状，发现当前该类案件的审判过程中还存在证据适用、司法认定、离婚损害赔偿完善等难点亟需疏通。论文提出提升维权意识、完善举证责任分配与证明标准、强化反家暴职能主体干预家暴的能力、完善离婚损害赔偿制度的适用等建议。

Domestic violence is a common social phenomenon all over the world. Violence from within the family and between close relatives has not been effectively curbed. It is not only a social problem, but also a legal problem. Based on the platform of China judicial documents network, this paper makes a big data analysis on the judgments of marriage and family cases involving domestic violence in Anhui Province in recent five years, combs the current situation of judicial application, and finds that there are still some difficulties in the trial process of the cases, such as the application of evidence, judicial determination and the improvement of divorce damage compensation, which need to be solved. By improving the awareness of safeguarding rights,improving the distribution of burden of proof and standard of proof, strengthening the ability of anti-domestic violence functional subjects to intervene in domestic violence, and improving the application of divorce damage compensation system, we can solve the difficult problems of domestic violence in civil litigation.
